Welcome to Horizon Sojourns. By accessing this website and/or engaging our services, you accept these terms and conditions in full. 1. Definitions
- "Our Service" refers to the bespoke journey planning, luxury flight bookings, adventure tour packages, visa & travel insurance facilitation, and corporate travel management services offered by Horizon Sojourns.
- "Client," "You," and "Your" refers to you, the person accessing this website and accepting the Company’s terms and conditions.
- "The Company," "Ourselves," "We," "Our," and "Us" refers to Horizon Sojourns.
- "Party," "Parties," or "Us" refers to both the Client and ourselves, or either the Client or ourselves.
2. Service Agreement
Horizon Sojourns provides comprehensive travel services including, but not limited to, bespoke journey planning, luxury flight bookings, adventure tour packages, visa & travel insurance facilitation, and corporate travel management. All services are subject to availability and the specific terms and conditions of third-party suppliers (e.g., airlines, hotels, tour operators, insurance providers) which will be communicated to you where applicable.
By engaging Our Service, you acknowledge and agree that Horizon Sojourns acts as an agent for these third-party suppliers and is not responsible for their acts or omissions, or for any loss, damage, or injury caused by them.
3. Bookings and Payments
- Quotations: All quotations provided by Horizon Sojourns are subject to change until a booking is confirmed and full payment or a deposit is received.
- Deposits and Full Payment: Specific deposit requirements and payment schedules will be advised at the time of booking. Failure to make payments by the due dates may result in the cancellation of your booking and forfeiture of any payments made.
- Pricing: Prices are quoted in Australian Dollars (AUD) unless otherwise specified. Prices may vary due to currency fluctuations, taxes, or supplier surcharges.
- Booking Confirmation: A booking is considered confirmed only upon receipt of full payment or required deposit and issuance of a confirmation document from Horizon Sojourns.
4. Cancellations and Refunds
- Cancellation by Client: Cancellation requests must be submitted in writing. Cancellation fees will apply and vary depending on the service provider, the nature of the service, and the time remaining until the travel date. These fees can be up to 100% of the total booking cost.
- Cancellation by Horizon Sojourns: In rare circumstances, Horizon Sojourns or our suppliers may need to cancel a booking due to unforeseen events. In such cases, we will endeavour to offer alternative arrangements or a full refund for the affected portion of the service, where applicable.
- Refunds: Refunds for cancelled services are subject to the terms and conditions of the relevant suppliers and may take several weeks to process. Horizon Sojourns will process any refunds due to the Client as quickly as reasonably possible.
5. Travel Documentation and Requirements
It is the Client's sole responsibility to ensure that all necessary travel documents (passports, visas, health certificates, international driving permits, etc.) are valid and obtained correctly for all countries visited or transited. Horizon Sojourns can assist with visa and travel insurance facilitation but does not guarantee the issuance of such documents.
Clients are also responsible for checking and complying with all health advisories, vaccination requirements, and customs regulations of their destination and transit countries.
6. Travel Insurance
Horizon Sojourns strongly recommends that all clients obtain comprehensive travel insurance at the time of booking to cover unforeseen events such as trip cancellation, medical emergencies, luggage loss, and personal liability. Our Service offers facilitation for travel insurance, and we can provide options, but the final decision and responsibility for adequate coverage rest with the Client.
7. Limitation of Liability
Horizon Sojourns acts as an agent for various third-party service providers. We do not own or operate aircraft, hotels, or other services. Therefore, Horizon Sojourns is not liable for any personal injury, death, property damage, or other loss, accident, delay, or irregularity which may be occasioned by reason of any act or omission on the part of any such third-party suppliers, or due to any act of God, force majeure, or other circumstances beyond our control.
Our liability for any claim arising from, or relating to, the services provided by Horizon Sojourns, whether in contract, tort (including negligence), or otherwise, will be limited to the amount paid by the Client for the specific service in question.
8. Client Responsibilities
- Provide accurate and complete information required for bookings and documentation.
- Review all travel documents immediately upon receipt to ensure accuracy.
- Comply with all laws, regulations, and customs of the countries visited.
- Behave in a manner that does not cause distress, danger, or annoyance to others, or damage to property.
9. Complaints
Should you have a complaint concerning any aspect of your booking or travel experience, you must notify the relevant supplier (e.g., hotel, airline) at the earliest opportunity. If the issue is not resolved to your satisfaction, please inform Horizon Sojourns in writing via email to info@horizonsojourns.com or by post to 2847 Flinders Street, Floor 12, Melbourne, VIC, 3000, AU, as soon as possible after your return, and within 30 days of the completion of your trip. We will endeavour to investigate and respond to your complaint promptly.
10. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Victoria, Australia. Disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
11. Amendments to Terms
Horizon Sojourns reserves the right to amend these Terms and Conditions at any time. Any changes will be posted on this page. Your continued use of Our Service after any such amendments constitutes your acceptance of the new Terms and Conditions.
